1.
The Customer agrees to a three (3) month contract, beginning upon
commencement of service.
2. First three (3) months payment plus a non-refundable setup charge,
if any, shall be due upon receipt of contract.
3. This agreement will automatically renew for successive three
(3) month periods for the life of the contract until canceled in
writing. Customers paying by credit card will be set up on our recurring
billing system and will be billed every 3 months. Customers paying
by check or money order will receive an invoice for charges and
payment is due upon receipt. There is a late charge of $15.00 on
all past due bills. If the account is cut off due to no payment,
there is a $25.00 reset up fee.
4. Initial payment is due with the contract. For accounting purposes,
renewal charges for contracts received on or after the 25th of the
month will accrue as of the 1st of the following month. By way of
example, an account setup on August 25th will be setup immediately
and the initial payment will be due with the contract. The initial
term of the agreement will be August 25 through November 30. The
first renewal charge will be due in December for second quarter
of services.
Billing,
Cancellation and Delinquent accounts
All accounts are paid in advance. Pricing is guaranteed only for
period of prepayment. Accounts overdue are subject to termination
and a $25.00 reset up fee.
Refund
Policy
If for some reason you need your account closed, let us know 30
days in advance and the remaining amount of your prepayment will
be refunded. Virtual Web Communications Liability Our liability
on any account is limited to the amount of money that the customer
has paid us. If we incur legal expenses due to a customer, we reserve
the right to recover these expenses from the customer. For example,
if you have violated a copyright and we are sued (although we shouldn't
be as an ISP), we may require you to pay our legal fees.
Violation
of Virtual Web Communications policies can result in warnings, suspension,
or termination of service, or in some cases, fines or legal action.
Virtual Web Communications reserves the right to change its policies
at any time for any reason.
Lawful
Use
Customers may not use Virtual Web Communications
facilities and capabilities to conduct or solicit the performance
of any illegal activity or to conduct any other activity which infringes
the rights of Virtual Web Communications or any third party.
Inappropriate
Material
Virtual Web Communications servers will not host or handle material
that contains nudity, pornography, obscenity, discriminatory/hate
propaganda, "warez" related sites, or sites that promote the illegal
distribution of software, passwords or similar material that causes
an overload of Virtual Web Communication's systems or results in reasonable
complaints from other customers or third parties.
Intellectual
Property Rights
Customers may not upload or transmit any message, data, images or
programs that would violate the property rights of others, including
unauthorized copyrighted text, images, music, or programs, trade secrets
or other confidential proprietary information, or trademarks, service
marks or trade names used in an infringing manner.
Internet
Junk Mail
(SPAM,
Flames, and Mail-Bombs)
Virtual Web Communications servers will not be the source, intermediary,
or destination address involved in the transmission of SPAM, flames
or mail-bombs. Virtual Web Communications servers will not be listed
in any spammed message, either as an originator, intermediary, or
reply-to address. Virtual Web Communications defines spam to be any
mass unsolicited message in the mediums of e-mail, newsgroups, or
web hosting. Virtual Web Communications defines flames/mail-bombs
to be any attempt to send large numbers of messages to a single or
multiple addresses in the mediums of e-mail, newsgroups, or web hosting.
Violation will result in immediate termination of all services without
refund, additionally theft of service fines or other legal action
may be imposed. Any customer who is repeatedly flamed/mail-bombed
or attracts such behavior will be asked to leave.
Interference
With Service
There shall be no attempt to gain unauthorized access to Virtual Web
Communications systems or accounts, disrupt service or network connectivity,
misuse Virtual Web Communications facilities, or create fraudulent
accounts.
Server
Abuse Issues and Hacking
Any attempts to undermine or cause harm to Virtual Web Communications
servers or a customer of Virtual Web Communications is strictly prohibited.
If you are found to have done so, your account will be terminated
without the benefit of any warning.
Slander and Privacy
Customers may not upload or transmit any information which is libelous
or defamatory, or which violates or infringes any right of privacy
of any person.
Customer
Privacy
Virtual Web Communications respects the privacy of its customers,
and will not sell, trade or give out the names of its customers.
Virtual Web Communications reserves the right to provide contact
information upon request in matters relating to potential legal
action, flagrant abuses, or as required by law.
Web
space and traffic / good faith policy
We expect our customers to use these resources
in good faith. The term "unlimited bandwidth" means that within
reason, users will not be charged for bandwidth use with that
plan. Within reason extends to a total use per month of 3GB per
domain. Note that currently 99% of subscribers come nowhere near
that amount of use. We reserve the right to limit your traffic
if your site is negatively affecting the performance of our other
customers. In addition, to prevent abuse:
Virtual Web Communications web space must be used as a facility
for web hosting only.
We
do not allow sites offering download files where 10% or more of
their monthly traffic is from file downloads.
Virtual Web Communications storage must not be used as a facility
for backup purposes
Any type of chat software is strictly prohibited (takes
up to much bandwidth).
All non-HTML files must be referenced by HTML files.
Viruses
In the event that any virus or destructive element is found or furnished
with any content, the customer will use their best efforts upon
learning that such situation exists, to immediately eliminate the
virus or destructive element. Customer will notify Virtual Web Communications
as to the existence of any such virus or destructive element immediately
upon discovery thereof, and Virtual Web Communications will have
the right to take any steps it deems necessary to eliminate the
virus or destructive element and to be reimbursed by the customer
for its costs relating to any such commercially reasonable steps.
Refusal
of service
Virtual Web Communications reserves the right to refuse service
to anyone at its sole discretion.
Criminal
Prosecution
There are numerous Federal, State and International laws regulating
the use of the Internet. Virtual Web Communications will not hesitate
to initiate criminal prosecution and/or cooperate with government
agencies relating to abuse of Virtual Web Communication's services
or systems.
